H1B Professional Visa

H1B visas are issued to foreign individuals in specialty occupations. To qualify for an H1B visa, you will need employer sponsorship. In recent years, the number of visas available for H1B professionals has decreased.

Aggressive Legal Services can help you evaluate your situation and your options. We can analyze your qualifications and discuss whether an alternative option may provide you with a better opportunity for a work visa. Also, if you are already in the United States and working under an H1B visa, we can help you with your renewal or discuss options for obtaining permanent residency through a green card.

We have been helping immigrant workers come to the United States for more than 15 years. We welcome questions, and we listen to you and your goals. We then work with you to develop the best strategy for achieving those goals.

United States H1B Visa Options and Alternatives
Because of Cap issues (the number of H1B visas allowed by Congress), many qualified immigrants are forced to seek other avenues for entry into the United States to work. H1B visa Cap options and alternatives may include the following:

H1B employer exemptions: Certain occupations and employers are exempt from the Cap limitations placed on H1B visas, including a higher education (or a related or affiliated nonprofit entity) and a nonprofit research organization or governmental research organization.

H1B advanced degree exemption: Each year 20,000 immigrants with advanced degrees from accredited U.S. institutions will also be exempt from the Cap limitations on H1B visas.

Other alternatives may also be available, including:

  • E2 Foreign Investor Visa
  • O Extraordinary Ability Visa
  • P Artists, Entertainers and Athletes Visa
  • L1 Multinational Transfers
  • TN Visa and NAFTA

Artists, Entertainers and Athletes Visa

Artists, entertainers and athletes can come to the United States to perform under a couple different non-immigrant visas, including an O visa and a P visa.

P visas are issued to artists, entertainers and athletes coming to the U.S. to perform or compete. O visas are for individuals with extraordinary abilities and can include artists, entertainers and athletes.

O visa requirements are more stringent than P visa requirements. Although both are non-immigrant visas, a P visa holder must maintain residence in their home country, while an O visa holder has no residency requirement. Generally, O visas are for longer periods of times.

Aggressive Legal Services can help you evaluate your situation and your goals to determine which visa would be best for you. If you fail to qualify for an O visa, we can help to determine if a P visa or other option is available to you. We provide prompt, courteous service extensive experience in assisting people with immigration or visa matters.

What You Need to Know About P Visa Applications
P visas are typically issued for a specific duration to coincide with the event(s) in which you are performing or competing. Therefore, it is very important that you detail everything to ensure you are able to stay for the needed duration.

Although P visa holders must voluntarily leave upon the expiration of their visa, while they are legally in the United States, they may seek permanent residency. If this is your intent, please let us know so we may begin developing a strategy to achieve your long-term goals.

We can assist immigrants who are already in the United States with a P visa, as well as immigrants wishing to enter the United States with a P visa.
